Section A: Customer Terms and Conditions.
1. Introduction:
Welcome to Rentlyzt! These Customer Terms and Conditions (“Agreement”) govern your access and use of the Rentlyzt platform to rent goods for your events. By accessing or using the platform, you agree to comply with and be bound by these terms.
2. Eligibility:
To use the Rentlyzt platform, you must be at least 18 years of age and capable of entering into a legally binding contract. You must also provide accurate and complete information during the registration process.
3. Use of Platform:
As a customer, you may browse, request, and rent goods listed by vendors for your personal or organizational events. You agree to use the platform in accordance with applicable laws, including Ghana’s Consumer Protection Act, 2023 (Act 1112).
4. Booking and Payment:
All rental bookings are subject to vendor approval and availability. You are required to make payments using the available payment methods on the platform. Payment must be completed before the delivery or pickup of items. Rentlyzt may hold funds until the transaction is confirmed to be successfully completed.
5. Cancellations and Refunds:
Cancellation and refund policies vary by vendor. It is your responsibility to review and understand each vendor’s policies before booking. Rentlyzt may issue refunds in cases of non-delivery, damaged goods, or vendor default, following an investigation.
6. Customer Responsibilities:
You are responsible for the care and proper use of all rented goods. Any loss or damage to items during the rental period will result in additional charges or forfeiture of your security deposit (if applicable). You agree to return items on time and in the condition received.
7. Prohibited Activities:
You must not: misuse or tamper with rented goods, provide false information or impersonate others, attempt to circumvent platform security, or use rented items for unlawful or dangerous purposes.
8. Consumer Protection and Privacy:
Your rights as a customer are protected under Ghana’s Consumer Protection Act, 2023 (Act 1112). This includes the right to accurate information, safe goods, choice, and redress. Your personal data is protected under the Data Protection Act, 2012 (Act 843). Rentlyzt ensures that personal data is collected and processed fairly, securely, and for lawful purposes only.
9. Dispute Resolution:
Any disputes related to bookings or services must first be reported to Rentlyzt support. We will mediate between you and the vendor to reach a fair resolution. If unresolved, disputes may be escalated to the Consumer Protection Authority (CPA) or other regulatory bodies.
10. Limitation of Liability:
Rentlyzt is a facilitator and not the provider of goods. We do not guarantee the quality, availability, or safety of items rented from vendors. Our liability is limited to the extent permitted by law.
11. Changes to Terms:
Rentlyzt reserves the right to modify these terms at any time. You will be notified of significant changes, and continued use of the platform constitutes acceptance of the revised terms.

Section B: Vendor Terms and Conditions.
1. Introduction:
Welcome to Rentlyzt! These Vendor Terms and Conditions (“Agreement”) govern your access and use of the Rentlyzt platform as a vendor. By signing up and using our services, you agree to be bound by these terms.
2. Vendor Eligibility:
To register as a vendor on Rentlyzt, you must be at least 18 years old. You are required to provide accurate and complete business information and comply with all applicable laws and regulations.
3. Vendor Obligations:
As a vendor, you agree to accurately list your products and services, ensure availability and timely delivery of rented items, and maintain high standards of customer service. You must not engage in fraudulent, misleading, or illegal activities and are expected to comply with Rentlyzt’s platform policies and community guidelines.
4. Fees and Payments:
All fees and commissions are waived for a period of 3 to 6 months from the date of signup. Fees and commissions may be introduced at any time between the 3rd and 6th month after signup, with prior notification. Vendors will receive payments after service completion, subject to our payout schedule. Any applicable taxes are the vendor’s responsibility.
5. Cancellations and Refunds:
Vendors must establish clear cancellation and refund policies. Rentlyzt reserves the right to issue refunds to customers under certain conditions, which may affect vendor payouts. Repeated cancellations may lead to account suspension.
6. Quality Assurance and Compliance:
Vendors must provide items in good condition and ensure compliance with safety and regulatory standards. Rentlyzt reserves the right to inspect listings and remove those that violate platform policies.
Vendors are required to comply with Ghana’s consumer protection laws, including but not limited to the Consumer Protection Act, 2023 (Act 1112), which ensures the right to information by providing accurate and clear information, the right to choice by offering competitive and varied options, the right to safety by ensuring products pose no harm, and the right to redress by facilitating complaint handling and compensation. The Act prohibits unfair trade practices such as false advertising and misleading claims, and vendors must cooperate with the Consumer Protection Authority (CPA) where required.
In accordance with the Sale of Goods Act, 1962 (Act 137), vendors must adhere to quality standards and ensure that all products are described accurately. Vendors must also comply with the Electronic Transactions Act, 2008 (Act 772) to ensure secure digital transactions and proper handling of customer data.
The Data Protection Act, 2012 (Act 843) safeguards consumer data privacy. This Act establishes the Data Protection Commission (DPC) to enforce compliance and defines personal data as identifiable information including name, ID, location data, or online identifiers. Vendors must comply with principles of data processing such as lawfulness and fairness (processing data with consent), purpose limitation (collecting data for specific lawful reasons), data minimization (collecting only necessary data), accuracy (keeping data up to date), storage limitation (not keeping data longer than necessary), and confidentiality and integrity (ensuring adequate security). Vendors must also respect the rights of data subjects, including access, correction, deletion, objection, and redress via the DPC. If vendors handle personal data, they must register as Data Controllers or Processors with the DPC. Cross-border data transfers are only allowed with proper protections or consent. Breaches of the Act may result in fines or imprisonment, and the DPC is authorized to investigate and sanction violations.
7. Vendor Account Management:
Vendors are responsible for maintaining the security of their accounts. Any suspicious activities should be reported to Rentlyzt immediately. Rentlyzt reserves the right to suspend or terminate vendor accounts for violations of this Agreement.
8. Liability and Indemnification:
Vendors are responsible for any damages, losses, or liabilities resulting from their services or products. Vendors agree to indemnify Rentlyzt against any claims, disputes, or legal proceedings arising from their listings or transactions.
9. Intellectual Property:
Vendors grant Rentlyzt a non-exclusive license to use their brand name, product images, and descriptions for marketing and promotional purposes. Vendors must ensure they have rights to any intellectual property used in their listings.
10. Modifications to Terms:
Rentlyzt reserves the right to modify these terms at any time. Vendors will be notified of significant changes and continued use of the platform constitutes acceptance of the revised terms.
11. Termination:
Vendors may terminate their accounts by providing written notice. Rentlyzt reserves the right to terminate vendor accounts for breach of terms, poor service quality, or customer complaints.
12. Governing Law:
This Agreement is governed by the laws of Ghana. Any disputes shall be resolved in accordance with the dispute resolution policies set forth by Rentlyzt and relevant regulatory authorities, including the Consumer Protection Authority (CPA) and the Data Protection Commission (DPC).
